Shekhar Jagtap is a litigation lawyer with over 19 years of experience in conducting cases before the Bombay High Court as well as Supreme Court of India related to international and domestic arbitration, banking and finance law, property, commercial law and criminal law.

Shekhar regularly conducts cases under Company law  as well as Insolvency & Bankruptcy Code, 2016 (IBC India)   related to financial recovery, liquidation, mismanagement and restructuring before the National Company Law Tribunal and its Appellate Authority. He has advised various companies as well as individual clients with regard to banking and corporate law under The Recovery of Debts Due to Banks & Financial Institutions Act, 1993 (RDDBFI Act India) and The Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002(SARFAESI Act India) in relation to guarantees and liquidation of assets by the banks and financial institutions.

ARBITRATION

Shekhar has significant experience and expertise in international and domestic arbitration under the Arbitration and Conciliation Act 1996. He has been advising and representing a UK based shipping company in enforcing and obtaining interim relief in arbitration proceedings in Mumbai with a dispute value of US$20 million in the London Court of International Arbitration.

Shekhar has represented number of construction companies in domestic arbitration cases before the panel of Arbitrator’s Tribunal, notably in a case involving a property dispute with damages to the value of US$3 million. He is currently instructed in a number of domestic arbitration cases involving the sugar industry, power industries & property disputes.

 

APPOINTMENT AS SPECIAL COUNSEL

Shekhar is appointed as a category “A” Panel Counsel member by the State of Maharashtra to conduct matters in the Supreme Court of India. He is appointed as a Special Counsel in the Supreme Court of India on cases related to the constitutional validity of a legislation related to the reservation policy of the Maharashtra State Government. The Water Resource Department and Common Entrance Test Cell of the State of Maharashtra has appointed Shekhar as a Special Counsel to represent these government bodies in the Bombay High Court as well as the Supreme Court of India. The Bombay High Court has appointed Shekhar as an amicus curie in a suo moto public interest litigation regarding the administration of criminal justice system.
